§1

DESCRIPTION OF SERVICES

This service and website is a private, third-party technical and administrative service provider assisting travelers with filing for the U.S. Electronic System for Travel Authorization (ESTA). We are an independent private entity and are NOT affiliated with, endorsed by, operated by, or connected to the U.S. Government, the U.S. Department of Homeland Security (DHS), or U.S. Customs and Border Protection (CBP). Our services include a user-friendly secure online portal, review of submitted information for completeness and obvious errors prior to government transmission, and customer support with application status tracking. The final determination to approve, reject, or delay any ESTA application rests solely and exclusively with U.S. Customs and Border Protection.

USER ELIGIBILITY & DECLARATIONS

By using our services, you confirm you are at least 18 years of age, or have the consent of a parent/legal guardian to apply on behalf of a minor; that you hold a valid, unexpired electronic passport (e-Passport with an integrated chip) issued by a participating Visa Waiver Program (VWP) country; and that you will provide accurate, truthful, and complete personal, passport, employment, and travel details. Submitting false or fraudulent information may result in application denial, revocation of travel privileges, and potential legal consequences under U.S. law.

FEES & PAYMENT TERMS

The U.S. Government levies a mandatory statutory fee for every ESTA application. We charge an additional operational service fee to cover our digital platform maintenance, document checking, customer support, and status monitoring. The combined total cost — statutory U.S. government fee plus our service fee — is clearly itemized prior to final checkout. All payments are processed securely through trusted, encrypted payment processing gateways.

APPLICATION PROCESSING & APPROVAL DECISIONS

We make reasonable efforts to process and submit applications to the official U.S. portal in a timely manner, though exact turnaround times are dictated by U.S. government immigration systems. Using our service does not guarantee ESTA approval or entry into the United States. An approved ESTA merely authorizes a traveler to board a carrier bound for the U.S. under the Visa Waiver Program; final admissibility is determined solely by CBP officers at the U.S. Port of Entry. We are not liable for delays caused by government server maintenance, administrative security holds, or incorrect data supplied by the user.

CANCELLATIONS & REFUND POLICY

You may request to cancel your order and seek a refund of our service fee only if our team has not yet processed and submitted your application data to official U.S. systems. Once your details have been transmitted to U.S. Customs and Border Protection, all statutory government fees and service fees become non-refundable. Refund requests must be submitted in writing via our contact form and will be assessed on a case-by-case basis.

ACCEPTABLE USE & USER RESPONSIBILITIES

When accessing our platform, you agree not to supply fraudulent, misleading, or stolen identity details; not to misuse our portal for unlawful purposes, including attempts to breach site security, introduce malicious code, or gain unauthorized administrative access; and not to fail to review your application summary for accuracy prior to payment.

LIMITATION OF LIABILITY

This service and site shall not be held liable for ESTA rejections, entry refusals at U.S. borders, canceled flights, missed connections, or financial damages arising from decisions made by U.S. government authorities. We accept no liability for service interruptions or processing failures resulting from force majeure events, government downtime, or internet connectivity issues beyond our reasonable control. Our total cumulative liability for any claim arising from your use of our service is strictly limited to the amount paid for our service fee.

DATA PROTECTION & PRIVACY

We process your personal information in strict compliance with our Privacy Policy. By utilizing our portal, you consent to the collection, transmission, and processing of your personal data as necessary to complete your ESTA application.

THIRD-PARTY SERVICES & EXTERNAL LINKS

Our platform may link to or integrate third-party websites, external software, or online tools, including payment processing gateways and helpdesk platforms. We do not control and are not responsible for the privacy practices, policies, security, or content of these external third parties, and your usage of such tools is entirely at your own risk. Third-party vendors who process user data on our behalf do so under compliant data processing agreements.

INTELLECTUAL PROPERTY

Except as modified by mandatory local consumer protection laws in §15, these Terms and any disputes arising out of or related to our services shall be governed by and construed in accordance with the laws of the United Arab Emirates.

SEVERABILITY

If any provision of these Terms is deemed unlawful, invalid, or unenforceable by a court of competent jurisdiction, that specific provision shall be severed, and the remaining provisions shall continue in full force and effect.

ENTIRE AGREEMENT

These Terms, alongside our Privacy Policy, constitute the complete legal understanding between you and this service regarding your use of our platform and service offerings.

§15

REGION-SPECIFIC PROVISIONS

These regional provisions apply additionally to consumers in specific jurisdictions; where they conflict with the general terms above, the regional provisions prevail for users residing in that jurisdiction.

15.1 EU CUSTOMERS — The EU GDPR (Regulation 2016/679) applies to personal data collected from EU residents, with cross-border transfers relying on European Commission-approved Standard Contractual Clauses (SCCs). Under the EU Consumer Rights Directive (2011/83/EU), EU consumers generally possess a 14-day statutory right of cancellation; however, if you request immediate processing of your ESTA application, this right of withdrawal is waived once performance has actively commenced. To cancel prior to processing, send a notice via our contact form stating: "I/We hereby revoke my/our agreement for the provision of the US ESTA assistance service ordered on [Date], Name: [User Name], Address: [User Address]." EU consumers may refer disputes to the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr or bring proceedings before the courts of their home Member State.

15.2 US CUSTOMERS — To the maximum extent permitted by applicable US laws, our service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. California residents possess specific rights under the CCPA to access, correct, or request deletion of personal information; we do not sell personal information. Under California Civil Code Section 1789.3, California users may reach out to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs. Prior to formal proceedings or arbitration, you agree to submit a written dispute description via our contact form and engage in good-faith informal negotiation for at least 60 days. Unresolved disputes shall be settled through individual binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules; you waive any right to participate in class actions or consolidated proceedings, and may opt out of this arbitration provision within 30 days of first using the platform by submitting written notice to our support team.

15.3 REST OF WORLD — For users outside the regions named above, mandatory local consumer protection laws apply to the extent they cannot be contractually excluded. Statutory rights regarding local cancellation windows, local data protection complaints, or local dispute access remain preserved.
